Off - Air Recordings

Highland Council has a licence agreement with the Educational Recording Agency

www.era.org.uk which allows the Council’s schools, adult and youth centres and education resource centres to record off-air, copy and store scheduled radio and TV programmes from the main broadcasters for educational purposes only.

Please note that our ERA licence does not cover online rebroadcast material such as programmes streamed on the BBC’s iPlayer, interactive services or Podcasts.

Our ERA licence allows us to record off-air on to DVD, video, CD or cassette formats and to transfer analogue off-air recordings to digital e.g. video to DVD.

Digital off-air recordings may also be stored on a licensed educational establishment’s internal server for viewing by classes, provided appropriate security measures are in place, but cannot be transmitted online between establishments. Licensed recordings may also be used in Power Point presentations.

Our ERA licence also allows licensed resource centres to supply schools with hard copies of programmes they have missed.

Channels covered by the ERA licence

Our licence covers scheduled broadcasts on BBC radio and TV, the ITV network, Channel 4, E4 , Channel 5 and S4C only. Recording Sky TV and other satellite or cable providers’ programmes is dependent on the licence agreement which accompanies the digital decoders.

As mentioned above our ERA licence does not cover interactive services available on digital television sets, nor does it cover on-demand services such as Podcasts or retrospective internet services such as the BBC’s iPlayer or Channel 4’s “Watch Online”. However when the broadcasters offer fixed viewing times for programmes on the internet (such as an important outside broadcasts) these may be treated as scheduled programmes and may be recorded under the ERA licence.

Off-Air Recording Procedures

Recordings may be made on school premises or at home by accredited employees e.g. teachers, school librarians or technicians. Recordings made at home must be in hard copy form i.e. DVD, CD etc.

It is illegal to make copies of pre- recorded, commercially produced recordings of TV or radio programmes.

Hard copy recordings may also be made at licensed education resources centres or at the premises of officially nominated third parties.

It is a condition of the licence that recordings or extracts of recordings are used as broadcast and are not edited, subtitled or adapted in any way they must always be used for strictly educational purposes only, i.e. viewed by pupils and teachers as part of a lesson. They are not to be sold, hired or used for general entertainment or be incorporated into websites or external computer databases.

All recordings or extracts must be labelled.

The recording together with its cover or case must include the following information.

  • Date of Recording

  • Name of Channel

  • Programme title

  • The wording :   “This recording is to be used only for educational and non-commercial purposes under the terms
     of
    the ERA Licence”

The above details must also be included if the recording is stored in an internal server.

Labelling

Pre-printed labels or templates are available direct from the ERA . To order email era@era.org.uk

Finally all recordings that are no longer needed must be destroyed.

Monitoring of Recording and Copying

  •  Licensees may be required to undertake and maintain at the request of the ERA details of television or radio programmes or any parts thereof which are recorded and the number of copies made under the licence. A small rotating sample of schools may be required to maintain detailed records of radio and TV programmes which they have recorded and copied.

  • It is a condition of the licence agreement that the ERA may have access to all the above records and also has access to premises to inspect the recordings to ensure that they comply with the terms of the licence agreement.   The ERA produce approved video spine labels carrying this message.
