The 1988 Copyright Act allows for the
copying of material by hand by teachers and students and for
very limited reprographic copying from books (1% in any calendar
quarter). However a licence agreement between the Highland
Council and the Copyright Licensing Agency (CLA)

allows more freedom in copying from books,
journals and periodicals. The main provisions of our current
licence agreement are listed below.
CLA
authorised representatives have the right to visit schools
during normal school hours to monitor copyright usage.
Seven days written notice must be given to the school before
such a visit.
Digital copies may not be altered in any way except to make
copies for visually-impaired pupils. Retyped copies must be
reproduced verbatim.”
All schools or premises connected with teaching may copy in one
academic year:

Up to 5% of a book published in the UK,
Australia, Canada, Denmark Finland, France, Germany, Greece,
Iceland, Ireland, Liechtenstein, The Netherlands, New Zealand,
Norway, South Africa, Spain, Switzerland and by participating US
publishers except for works and titles included in the latest
list of Excluded Categories and Excluded Works published by the
CLA .

One copy, as above, for the personal
use of each member of class plus the teacher. Where
the copies are intended for a meeting of parents, teachers or
other authorised persons the number of copies shall not exceed
the numbers attending the meeting.

One article from a journal or magazine.

In the case of a collection of short
stories or poems, one short story or poem not exceeding ten
pages in length.

One complete chapter from a book.

Enlarged or reduced copies may be made for
pupils or teachers who are visually impaired provided that at
least one copy of the original material has been bought by the
school.

Acetates and enlarged copies may be
made for teaching purposes provided that these materials are
not commercially available.
Digital Copies
School staff can now authorise the making of digital copies for
internal use under the new CLA/LTS/GLOW pilot licensing scheme.
Copies may be
scanned or retyped from material published in the
UK
or
USA
only and may be incorporated in digital whiteboard
presentations, PowerPoint presentations and in Virtual Learning
Environments (VLE’s). However the use of OCR (Optical Character
Recognition) software
is not allowed.
All digital copies must be identified with details such as
author, title, publisher ISBN/ISSN at the foot of each page.
This is particularly important information for GLOW pilot
licence surveys.
Exclusions include:
Printed music
Newspapers
Maps, charts, tables
Published examination papers
Workbooks
Material described
in the CLA list of excluded categories and works. Please check
